1) Introduction 

1. a) Welcome to www.namibpages.com (Here on referred to as “Namibian Pages”). By accessing Namibian Pages you are agreeing to the following terms, which are designed to make sure that Namibian Pages works for everyone. Namibian Pages is provided to you by IT Guru Namibia, Swakopmund, Namibia. This policy is effective 1st October 2014.
1. b) Namibian Pages is an online business directory where we provide a venue to allow our users who comply with these Terms detailed below to find businesses in their area who fulfil the users requirements. Namibian Pages is not involved in communications between user and business. As a result, you hereby acknowledge and agree that Namibian Pages has no control over any interaction, and shall have no liability to any party in connection with such interaction. You use the Service and the Website at your own risk.
1. c) You understand that Namibian Pages does not control nor is not responsible for adverts, directory information, business listings/information, communications outside Namibian Pages’ systems or other means of electronic communication, comments, user postings, files, images, photos, video, sounds, or any other material made available through the Website
1. d) By using the Website and the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. You acknowledge and agree that you are solely responsible and liable if you choose to reply on the content previously mentioned and that under no circumstances will Namibian Pages be liable in any way for the Content or for any loss or damage of any kind incurred as a result of the use of any Content listed, e-mailed or otherwise made available via the website.
1. e) You acknowledge and agree that Namibian Pages does not moderate any content, but that Namibian Pages has the right, in its sole and absolute discretion, to refuse, delete or move any content that is or may be available through the website, for violating these Terms or for any other reason or no reason at all.
1. f) Furthermore, the Website and Content available through the website may contain links to other third party websites which are completely unrelated to Namibian Pages. If you link to Third Party Websites, you may be subject to those Third Party Websites’ terms and conditions and other policies. Namibian Pages makes no guarantee as to the accuracy or authenticity of the information provided in any such Third Party Website, and by linking to any other websites is completely at your own risk and Namibian Pages disclaims all liability thereto.

2)Use of Namibian Pages.

2.1)By using Namibian Pages you agree that you will not:

2.1.a) Violate any laws;

2.1.b) Violate any copyrights or patents;

2.1.c) Post any threatening, abusive, defamatory, obscene or indecent material;

2.1.d) Be false or misleading;

2.1.e) Infringe any third-party right;

2.1.f) Distribute or contain spam, chain letters, or pyramid schemes;

2.1.g) Distribute viruses or any other technologies that may harm Namibian Pages or the interests or property of Namibian Pages users;

2.1.h) Impose an unreasonable load on our infrastructure or interfere with the proper working of Namibian Pages this includes attempting to gain unauthorized access to computer systems owned or controlled by Namibian Pages and their hosting partners or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the Website.

2.1.i) Copy, modify, or distribute any other person’s content without their consent;

2.1.j) Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Service, except for internet search engines (e.g.,. Google) and non-commercial public archives (e.g. archive.org) that comply with our robots.txt file;

2.1.k) Harvest or otherwise collect information about others, including email addresses, without their consent;

2.1.l) Bypass measures used to prevent or restrict access to Namibian Pages.

2.1.m) Post the same item or service in multiple categories or forums, or in multiple metropolitan areas unless valid proof is provided to support the coverage;

2.2) You are solely responsible for all information that you submit to Namibian Pages and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete or take-down content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user’s usage of the site either temporarily or permanently, or refuse a user’s registration.

2.2.a) By posting said content, you acknowledge that: (i) you own or have the necessary licenses, rights, consents, and permissions to use such Content(ii) you have the written consent, release, and/or permission of each and every identifiable individual person or business in the Content to use the name or likeness of each and every such identifiable individual person or business to enable inclusion

3) Abuse of Service

Namibian Pages works to keep the site working properly and the community safe. Please report problems, offensive content and policy breaches to us by emailing us at abuse @ namibpages.com.

We reserve the right to issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Namibian Pages if we believe that they are in breach of our terms of use. If we decide to take any of these steps, we do not accept any liability for monitoring Namibian Pages or for unauthorized or unlawful content on Namibian Pages or use of Namibian Pages by users. You also recognise and accept that Namibian Pages is not under any obligation to monitor any data or content which is submitted to or available on the site.

4) Fees and paid services.

4.a) The use of Namibian Pages is generally free, but there are fees linked to certain services. If one of the services you would like to use has a fee attached to it, you will be notified accordingly and given a chance to accept the fee. Our fees are quoted in Namibian Dollars (N$), and we reserve the right to change them from time to time. Changes to said fees will be conveyed to users via the website. We reserve the right to temporarily change our fees for promotional events and/or new services; these changes are effective for the duration of the promotion.

4.b) Our fees are non-refundable, and you are responsible for paying them when they’re due. If you don’t, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

5) Content hosted on the website.

Namibian Pages contains content from us, you, and other users. Namibian Pages is protected by copyright laws and international treaties. Content displayed on or via Namibian Pages is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions.
5.a) You agree not to copy, distribute or modify content from Namibian Pages without our express written consent.
5.b) You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Namibian Pages. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of Namibian Pages (other than your own content).
5.c) When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content
5.d) You may display on your website, or create a hyperlink thereto, individual postings on the Service so long as such use is for non-commercial and/or news reporting purposes only (e.g., personal blogs or other personal online media). You are not to exceed fifty (50) links and/or posts, if you exceed this number your use will be considered to be in violation of these Terms, unless Namibian Pages expressly grants you permission otherwise.
5.e) You are also permitted to create a hyperlink to the home page of the Website so long as the link does not portray Namibian Pages, its employees, affiliates or agents in a false, confusing, misleading, derogatory, or otherwise offensive matter.
5.f) You agree not to hold us responsible for things other users post or do.
5.g) We do not moderate postings and are not involved in the actual transactions between users. We do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered.
5.h) In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law.
5.i) We do not guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.
5.j) We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Namibian Pages, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

 

6) Infringement.

Do not post content that infringes the rights of third parties, This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). A large number of varied products and services are offered on Namibian Pages by private individuals in Namibia. If you feel your copyright, trademark or other rights have been infringed by a post, you are entitled to report the post to Namibian Pages to have it removed. If a legal representative reports the infringement through the correct channels, all infringing postings will be removed.

6.a) Reporting an infringement.

To report an infringement of your rights( only Copyright, Trademark or intellectual property) email your full contact details, proof of said rights as well as the suspected infringement post link to infringement @ namibpages.com.
Please not that this can only be done by the lawful owner of said rights or their legal representatives.

7) Security.

Namibian Pages reserves the right at its discretion to take whatever action it finds necessary to preserve the security, integrity and reliability of its network and back-office applications. Any user who commits any of the offences detailed in Chapter 13 of the Electronic Communications and Transactions Act, 2002 (specifically sections 85 to 88 (inclusive)) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by Namibian Pages and its affiliates, agents and/or partners.

8) NO SPAM POLICY

You agree that sending unsolicited email advertisements or other unsolicited communications to Namibian Pages email addresses or through Namibian Pages systems are expressly prohibited by these Terms. You acknowledge and agree that from time to time Namibian Pages may monitor email usage using human monitors or automated software to flag certain words associated with spam or scams in emails that are sent between one user to another in the Namibian Pages email system. Any communication between yourself and any other user utilizing the communication features available on the website may be used only in accordance with the Terms. Any unauthorized use of Namibian Pages computer systems is a violation of these Terms

9) LIMITATION AND TERMINATION OF SERVICE

9.a) You acknowledge and agree that Namibian Pages may establish limits from time to time concerning use of the Service, including among others, the maximum number of days that Content will be maintained or retained by the Service, the maximum number and size of postings, e-mail messages, or other Content that may be transmitted or stored by the Service, and the frequency with which you may access the Service or the Website.
9.b) You acknowledge and agree that Namibian Pages has no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Website or the Service.
9.c) You acknowledge and agree that Namibian Pages reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that Namibian Pages shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the Service.
9.d) You acknowledge and agree that Namibian Pages, in its sole and absolute discretion, has the right (but not the obligation) to delete or deactivate your account, block your e-mail or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason or no reason at all, including, without limitation, if Namibian Pages believes that you have violated these Terms. Further, you agree that Namibian Pages shall not be liable to you or any third-party for any termination of your access to the Website or the Service. Further, you agree not to attempt to use the Service after any such termination.

10) General.

These terms and the other policies posted on Namibian Pages constitute the entire agreement between Namibian Pages and you, superseding any prior agreements.

We may provide a translation of the English version of the Terms into other languages. You understand and agree that any translation of the Terms into other languages is for your convenience only and that the English version governs the terms of your relationship with Namibian Pages. Furthermore, if there are any inconsistencies between the English version of the Terms and any translation, the English version of the Terms shall govern.

We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the site, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
